Terms of Service

1. Acceptance of Terms

By accessing therarityclub.com or purchasing any product from The Rarity Club ("we," "us," "our") on Whatnot or any other platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

2. Description of Services

The Rarity Club produces and sells Professionally Sealed Surprise Products consisting of Pokémon Trading Card Game cards, opened live on Whatnot. Our pull list and card checklists are published at therarityclub.com.

3. Surprise Products & All Sales Final

All Professionally Sealed Surprise Products are sold as-is. By purchasing, you acknowledge:

• You understand you are purchasing a sealed surprise product and results are random
• All sales are final — no refunds or exchanges except where required by law
• Cards pulled during live shows are the cards you receive; no substitutions
• Card values fluctuate and we make no guarantees regarding the market value of cards received

4. Checklist & Series Transparency

We publish a complete checklist of all cards included in each series at therarityclub.com/checklist prior to sealing. Once a series is sealed, its contents cannot be changed. Any new products created from additional items constitute a new series.

5. Card Condition

All cards are Near Mint (NM) unless explicitly stated otherwise on the product listing. Graded cards will clearly display their grade and grading company (PSA, BGS, CGC, etc.) on the listing.

6. Prohibited Conduct

You agree not to:

• Use our website for any unlawful purpose
• Attempt to gain unauthorized access to any part of the site or its backend systems
• Misrepresent your identity or engage in fraudulent transactions
• Harass, threaten, or abuse The Rarity Club staff or community members

7. Intellectual Property

All content on therarityclub.com, including the site design, branding, and pull list interface, is the property of The Rarity Club. Pokémon card images and names are trademarks of Nintendo / The Pokémon Company and are used for identification purposes only. We are not affiliated with or endorsed by Nintendo or The Pokémon Company.

8. Third-Party Platforms

Purchases made through Whatnot are subject to Whatnot's Terms of Service. We are not responsible for Whatnot's platform policies, fees, or dispute resolution processes.

9. Limitation of Liability

To the maximum extent permitted by law, The Rarity Club shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services or products, including but not limited to loss of value of cards received.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to conflict of law provisions.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Updated terms will be posted on this page. Continued use of our services after changes constitutes acceptance.
